Worker Cannot Be Dismissed by Current Employer Due to Disclosures Made About Previous Employer, Says EAT
Employees have always been apprehensive about whistleblowing, considering the effect such disclosures have on their career. Often workers find them dismissed from their job as soon as they disclose anything wrong on the part of their employers. Since the industry is usually small, it becomes difficult for the workers to even find an alternate job. Other employers are also wary of whistleblowers as they think that these workers may inform authorities about certain aspects of their businesses also and cannot be trusted to keep such matters secret.
Something similar happened to Paul Elstone. Mr. Elstone was employed with Petrotechnics till June 2008 after which he was let go because he had informed one of the company’s clients, BP, about some misconduct on the part of the company regarding BP itself. While the disclosure was protected by Section 47b of the Employment Rights Act 1996, Elstone was still dismissed. He joined BP as a consultant but found himself out of a job again when BP also asked him to leave, for the same reason, i.e., the disclosures he had made to them whilst employed by Petrotechnics.
The Employment Appeal Tribunal (EAT) had to decide whether Section 47b of the Employment Rights Act 1996 protects the rights of a worker against only the present employer or the future employers as well. The Tribunal has just decided that the wordings of the Section protect the workers against future employers as well. Therefore people like Elstone are protected by the Act. This ruling will bring clarity to the law.
Declan O Dempsey, an advocate from Cloisters, the legal firm that was representing Elstone, also stated that this will make sure that whistleblowers can do their duty without fear. However, the decision regarding the disclosures made by Mr. Elstone and the way he was dismissed is still pending.

Fake References and Lies Result in Imprisonment for NHS Employee
Lies about A levels and fake employment reference just landed a NHS employee six months of imprisonment.
The employee, Rhiannon Mackay, had applied for the post of a Capital Projects Administrator for Plymouth Hospitals NHS Trust at a salary of £23,000 annually. The post needed two A-levels and she claimed to have two B-Grade A levels. She was also required to furnish references and a discharge letter from her last employer, the Royal Navy, and she provided a forged Navy Discharge Certificate and a fake reference.
Though she had been in job only for a year, her incompetence made her managers question her skills and when they raised concerns about the qualifications, the forgery came to the fore. Mackay was prosecuted and the court was told that she had also furnished fake documents while applying to 11 other places.
Her lawyer said that she was currently suffering from depression and post-traumatic stress disorder.
In a similar case last week, a senior manager of NHS with 19 years of experience with the employer was punished with 12 months imprisonment with suspension and was asked to provide free community service for at least 200 hours after it was found that he has lied about his qualifications.
A HireScores research last year revealed that almost 69% of employees have lied to their employers about one thing or the other for getting jobs.
