Report Highlights Deficiencies in Asbestos Laws

From dermatitis to lung cancer the scourge of asbestos related diseases will continue unabated or may get aggravated in the near future as a result of serious defects in the rules dealing with the management of asbestos in people’s homes.

The findings of a new academic report, titled “As Safe as Houses?”, commissioned by construction union UCATT and prepared by Dr Linda Waldman and Heather Williams, claim that there is a gulf of difference in the manners in which individual local authorities and registered social landlords (RSLs) resort to when informing occupants about whether properties contain asbestos materials and the likely risk of exposure.

As an extension of the current obligation towards asbestos management in communal zones such as stairwells, the report recommends that all social landlords should undertake the responsibility of managing asbestos in the internal part of properties as well. Maintenance of an asbestos register for all properties by social landlords has also been proposed.

Home Information Packs and most surveys do not contain reports on asbestos presence in a property. Only an expensive full structural survey would give a clear picture of how safe a home is for its future residents. The report recommends that a thorough asbestos surveying should be carried out prior to all private housing sales in the interest of the future residents.

The report also recommends that additional measures are urgently needed to ensure that construction and maintenance workers are aware of the risks posed by asbestos, where asbestos can be located, the difficulty in identifying it, and how to safely remove it if discovered.

The report calls for all power tools to carry warnings against asbestos and the potential dangers it poses. Comprehensive training on all aspects of asbestos risk management should be imparted to all local authority staff and resident association representatives.
